General terms and conditions of sale

Article 1. Subject
At https://www.carlafailela.it you can purchase Gift Vouchers, with which you can later choose when to enjoy the spa experience, or services booked for a desired date/time. This site is intended for end customers and not for VAT-registered individuals,

1.1 Gift Voucher
The Gift Voucher is a document originated electronically by Failela Snc that offers its holder the opportunity to use the services provided therein.
The booking and use of the service can be made within the term of 12 months from the purchase (unless otherwise indicated) and are subject to the requirements and limitations better identified below.
Each Gift Voucher is identified by a numeric serial code that the consumer must communicate when booking the service, so that it can be confirmed and used validly. The alphanumeric serial code and reference contacts of Failela Snc are made available in the text of the Gift Voucher itself.
The Gift Voucher allows that the consumer of the service can also be a person other than the purchaser, since it is a product that can be intended as a gift to a third person.

1.2 Services booked for a date/time
When purchasing services you must later contact the facility to agree on the date and time available.

Article 2. Purchase from site
When purchasing, you must check that you have filled in all the fields correctly before proceeding to send the order.
The purchase takes place with the forwarding by Failela snc, through the site, of a confirmation e-mail summarizing the services selected and the simultaneous payment of what is indicated therein. The sale is deemed completed subject to the successful completion of the payment transaction.
Henceforth, in order to better understand how the services are used, the following definitions are specified:

• Client: one who purchases Gift Voucher or services booked for a date/time
• Beneficiary: the one who uses the services of the Gift Voucher

All purchases concluded by consumers through https://www.carlafailela.it/ imply that they have read and fully accept this document.
Failela Snc reserves the right to modify these GENERAL TERMS AND CONDITIONS at any time, at its discretion, without prior notice. Any changes will not be retroactive and will apply only to sales concluded from that date.
The content, benefits, terms and conditions of enjoyment and cancellation of the services illustrated in the Gift Voucher or confirmation email, are objectively predetermined and accepted at the time of purchase and also apply to the Beneficiary.
Purchases concluded online preclude the possibility of receiving refunds against other commercial promotions and/or conventions and/or discount vouchers.

Article 3. Prices and terms of payment
Prices are given in euros and are those in effect at the time of purchase, including VAT. Customers have the following method of payment: Credit Card (Visa, Google Pay, Apple Pay, Marstercard).
The Customer is transferred to a secure site and the credit card details are communicated directly to the Banking Institute that handles payments on behalf of Failela Snc. The transmitted data is sent in a protected mode, by means of encrypted data transfer with SSL (SecureSocketLayer) system. These data are not accessible even for Failela Snc.
Payment is concurrent with the purchase through the site and is in the nature of a security deposit. The tax document (receipt or invoice at the customer’s request) is issued and delivered at the same time as the use of services directly at the site, including for Gift Vouchers. Gift Vouchers are not intended for intermediate sale,

Article 4. Method of reservation

4.1 Booking services included in the Gift Voucher
The recipient of the Gift Voucher should contact directly at 0445 630047 to book the date and time when he/she would like to take advantage of the services indicated on the Gift Voucher.
The booking of the voucher can be made after 48 hours from the purchase. It is recommended to make the reservation well in advance of the chosen date, especially for weekends and holiday periods.
Confirmation of the reservation is subject to the availability dedicated to the Failela Snc commecial initiative and in certain periods (e.g. holidays, private events, ..) reservation requests may not be accepted.
You can use the services no later than the expiration date of the Gift Voucher (12 months from the date of purchase shown on the Gift Voucher itself, unless otherwise indicated). After this deadline, the Gift Voucher is no longer usable and will not be refunded.

Article 5. Modification or cancellation of the booked service
It may happen that it is necessary to change the booking of services, even those included in a Gift Voucher already fixed. In order to proceed, it is necessary to cancel the booked service and make a new reservation by contacting us at 0445 630047.

All changes and/or cancellations are reconfirmed by Failela Snc in writing, without which, the file remains confirmed as originally.

Article 6. Limits of application
6.1 Capacity
All customers purchasing or booking on https://www.carlafailela.it/ formally declare that they are of legal age and possess full capacity. The Beneficiary declares himself to be financially responsible for the use of the site on his behalf or on behalf of third parties, including minors under his guardianship, without prejudice to the possibility of proving that there has been fraudulent use not attributable to his negligence. The information disclosed will be considered true. Any use of https://www.carlafailela.it/ in violation of these GENERAL TERMS AND CONDITIONS may imply the refusal by Failela Snc to accept the order and/or access the services requested.

Article 7. Client and Beneficiary Data
When purchasing the services, it is up to the Customer to communicate the data required for acceptance of the purchase order.
Failela Snc is not responsible for any delays and/or non-delivery due to the Customer’s incorrect information.
In the event that the Gift Voucher is not delivered, it is the Customer’s responsibility to contact 0445 630047 for the appropriate checks. If the Customer does not communicate the non-delivery, the shipment is considered successful and forfeits the right to request a new shipment.

Article 8. Anti-fraud precautions in case of theft or loss of the Gift Voucher
In view of the fact that the Beneficiary of the Gift Voucher may also be a person other than the Client, since the right to use the service derives from the availability of the alphanumeric serial code indicated in each Gift Voucher, it is up to the Client and the Beneficiary to have the utmost diligence in the custody of the Gift Voucher. In any case, it should be noted that Failela Snc has created a control procedure to limit fraud as much as possible and to protect its Customers.
It is the responsibility of the Customer and/or Beneficiary to communicate any possible subtraction of the Gift Voucher in order to allow the same to be deactivated and any replacement can be made. Such communication, implying the assumption of responsibility, must be formalized in writing and signed by the Client and the Beneficiary indicated at the time of purchase and sent via e-mail to the e-mail address failela1952@gmail.com
The Client acknowledges that, in the event of any such irregularity, the Gift Voucher may be validly blocked (and therefore the reservation rejected) without implying any liability on the part of Failela Snc.

Article 9. Liability related to the use of the site https://www.carlafailela.it/
The Client acknowledges and unconditionally accepts that Failela Snc, in view also of force majeure events and/or events attributable to third parties, cannot guarantee the perfect continuity of the service provided through the website https://www.carlafailela.it. In the event of interruption or incompatibility of the site with the Client’s computer systems, any resulting inefficiency cannot under any circumstances be attributed to the responsibility of Failela Snc.

Article 10. Validity and terms of use of services booked for a date/time and/or Gift Voucher
10.1 Booking services for a date/time
The Client is required to report to the facility on the day and time indicated on the booking confirmation e-mail summary. The guarantee and priority of access are valid only in the booked time slot. In case of delay, priority of entry to the Center will not be guaranteed and in case of booked treatments there may be loss of use of the booked service.

10.2 Gift Voucher
The Grantee must use the services, included in the Gift Voucher itself, no later than the expiration date of the Voucher (valid 12 months from the date of purchase shown on the Gift Voucher itself, unless otherwise indicated). After this deadline, the Gift Voucher will no longer be usable.
The Client and the Gift Voucher Recipient, at their own care and diligence, are required to observe and control the expiration date.
In case of any doubts and/or difficulties of any kind, the same may contact 0445 630047 to request all relevant clarifications.
Once the services have been booked, the Client is required to appear at the facility on the day and time indicated on the e-mail confirmation summarizing the reservation, bringing with him/her the Gift Voucher, which must be compulsorily presented at the facility upon arrival, otherwise the services contained therein, even if booked, will not be enjoyed.
The guarantee and entry priority are valid only in the booked time slot. In case of delay, priority of entry will not be guaranteed.

Article 13. Applicable law
Any contract of sale concluded between Failela Snc and the Customers pursuant to these GENERAL TERMS AND CONDITIONS shall be governed by and construed in accordance with the laws of Italy.
In any event, any rights attributed to the Customers by mandatory provisions of law in force in the State of the latter shall be unaffected.
